The ACLU is challenging a new bail law which it argues creates unlawful restrictions on nonprofit organizations that assist criminal defendants with paying cash bail, reports the Courthouse News Service. The ACLU is seeking an injunction against the law, claiming that it singles out one nonprofit advocating for the end of cash bail, The Bail Project–the only organization in Indiana paying cash bail on a continual basis for criminal defendants—and places unconstitutional restrictions on its activities. The law is slated to take effect on July 1, and regulates organizations that pay bail of more than three individuals in a 180-day period and requires such groups to obtain certification. The lawsuit takes aim at the certification requirements, claiming that they are vague and that their enforcement is left to the discretion of the commissioner of the Indiana Department of Insurance.
