Scott Storey, the district attorney in Jefferson County, Colorado, said yesterday that he will ask a grand jury to investigate whether an off-duty Arapahoe County sheriff’s deputy should face criminal charges for shooting a man to death during a traffic altercation earlier this month. The deputy, Daniel Montana Jr., shot and killed David Rossiter, 24, on Nov. 2 during a roadside dispute in Lakewood, Colo.
Montana, 49, has worked in the Arapahoe County Jail since 1991. He has been placed on administrative leave, pending the outcome of the investigation.
The deputy was on his way home when he got into an argument with two men in a pickup truck. Police are investigating reports that the fight began after someone in the pickup truck flicked a cigarette butt, which landed on Montana’s private vehicle.
