Rape Victim’s Parents Sue D.A.

A 16-year-old girl authorities say was the victim of statutory rape by an assistant sheriff’s son — who also is charged in the videotaped gang rape of another teenager– has sued the Orange County district attorney , the San Diego Union-Tribune reports. Her attorney says the girl will not cooperate in the statutory rape prosecution against Gregory Haidl, saying their July 13 sexual encounter was consensual.

The federal lawsuit, in which the girl is not named, claims she was forced to give a DNA sample against her will and asks that prosecutors be barred from using that sample as evidence against Haidl. The 19-year-old Haidl is one of three men charged with the videotaped rape of a 16-year-old girl at a July 2002 party at the home of his father, Orange County Assistant Sheriff Don Haidl, who was not home at the time.
