New York’s highest court ruled that limitations on judges’ right to free speech were necessary to preserve the public’s confidence in the judiciary’s fairness and impartiality.
In unanimous decisions in two cases, the seven-member Court of Appeals contradicted a federal judge who ruled recently that judges and judicial candidates in New York have the same constitutional right to participate in most political activities that ordinary citizens have.
